Civil forfeiture is a massive unjustified threat to property and due process rights. As the third edition of Policing for Profit: The Abuse of Civil Asset Forfeiture shows, most state laws still stack the deck against property owners and give law enforcement perverse financial incentives to pursue property over justice. Proponents claim forfeiture is an important crime-fighting tool, but new research finds otherwise: There was no increase in crime after New Mexico abolished civil forfeiture and the profit incentive in 2015. Strong forfeiture reform does not sacrifice public safety. As states and Congress look for ways to create a fairer criminal justice system, one reform everyone should be able to agree on is ending civil forfeiture and the perverse profit incentive that fuels it.
